UBUNɅTION Terms of Use
General Terms and Conditions of UBUNTU NATION AG for ubunation.io / ubunation.com
Version 1.3 – effective 1 November 2026. Replaces the General Terms and Conditions of 31 July 2023.
1. Who we are and when these Terms apply
These General Terms and Conditions ("Terms") govern the use of ubunation.io and ubunation.com including all subdomains (the "Platform"), operated by UBUNTU NATION AG, c/o Interconsulting Group AG, Chamerstrasse 176, 6300 Zug, Switzerland, UID CHE-139.883.558, e-mail info@ubunation.com ("UBUNɅTION", "we"). By using the Platform, creating an account or making a donation you accept these Terms. Each campaign page contains the specific details of that campaign (Charity Partner, donation amount per collectible, currency, number of collectibles, campaign period, allocation of donations, rewards with their period and cut-off date); they form part of these Terms and prevail over them for that campaign. If you are a consumer, the mandatory consumer protection law of your country of residence remains unaffected.
2. What UBUNɅTION does
UBUNɅTION is a donation platform. We initiate and run donation campaigns in favour of charitable organisations ("Charity Partners"): we provide the Platform, design a limited collection of digital collectibles for each campaign, approach ambassadors ("Voices"), promote the campaign, receive the donations on behalf of the Charity Partner and forward the Charity Partner's share. The basis is a written campaign agreement with the Charity Partner in which the Charity Partner agrees to the allocation described in Section 4.
The Charity Partner is the beneficiary of the campaign. It carries out no commercial activity on the Platform, sells nothing and is not involved in approaching supporters; the campaign is initiated by UBUNɅTION. UBUNTU NATION AG itself is a company, not a charitable organisation.
UBUNɅTION is an independent and neutral platform. We have no corporate ties to any Charity Partner, and no Charity Partner holds a stake in UBUNɅTION. All Charity Partners work with us on the same terms: the same allocation of donations, the same transparency, the same payout. We decide on the admission of a campaign according to uniform criteria, in particular charitable status, traceable use of funds and reporting by the Charity Partner.
3. Donations and collectibles
3.1 Donation. When you support a campaign, you donate the amount shown on the campaign page in favour of the Charity Partner. UBUNɅTION receives the donation on behalf of the Charity Partner and applies it as described in Section 4. The donation is voluntary; you do not acquire anything with it.
3.2 Collectible as a thank-you. For each donation you receive, as a thank-you, a collectible from the campaign's collection: a digital image with a unique number that documents your support and remains linked to your account or e-mail address. The collectible is symbolic. It has no monetary value; it is not a currency, security, investment or financial instrument; it confers no rights against UBUNɅTION or the Charity Partner; and it cannot be exchanged for money, sold or traded.
3.3 Use. You may display, download and share your collectible for private, non-commercial purposes, for example on social media and in your profile. The rights in the artwork remain with UBUNɅTION, the Charity Partner or the artists involved; commercial use, alteration, or any use suggesting an endorsement by the Charity Partner or a Voice is not permitted.
3.4 Blockchain. We may record a cryptographic fingerprint of a collectible together with its number on a public blockchain to prove its authenticity and uniqueness. You need neither a wallet nor cryptocurrency for this, and no token with monetary value is created. Entries on a public blockchain are permanent and public; we do not record your name or e-mail address there.
3.5 Donation confirmation. UBUNɅTION does not issue tax-deductible donation receipts. You receive a donation confirmation from us by e-mail. At your request we pass your name, address and donation amount on to the Charity Partner so that it can issue you a receipt, where it is entitled to do so.
4. Where the money goes
4.1 Allocation. From each donation, the payment providers' fees and any currency conversion costs and taxes are deducted first. Of the remaining net amount, 80% goes to the Charity Partner and 20% to UBUNɅTION. The UBUNɅTION share covers platform development and operation, production of the collectibles, marketing, payment processing, supporter care and the planning of further charity campaigns and partnerships with charitable organisations. Example: for a donation of CHF 100 with payment fees of CHF 3, the net amount is CHF 97; the Charity Partner receives CHF 77.60 and UBUNɅTION CHF 19.40. This allocation is shown on every campaign page.
4.2 Forwarding. Donations received for a Charity Partner are recorded separately per campaign and paid out to the Charity Partner monthly at the end of each month. Refunds and chargebacks arising after a payout are set off against the next payout. The Charity Partner reports on the use of the funds; we share this information on the campaign page.
4.3 Platform campaigns. Campaigns that support UBUNɅTION itself (for example the UBUNɅTION Founders Badge) are marked as such; these contributions go entirely into the development of the Platform and are not forwarded to a Charity Partner.
4.4 Loss of a Charity Partner. If a Charity Partner ceases to exist or seriously breaches its obligations, we forward any shares not yet paid out to a charitable purpose as close as possible to the original one and inform supporters on the campaign page.
5. Donation process, payment and withdrawal
5.1 Process. You select the campaign and the number of collectibles, enter your e-mail address and country of residence (or log in), choose a payment method, check your entries and confirm the donation. Until then you can correct your entries. Once the payment provider confirms the payment, the donation is complete; you receive a donation confirmation by e-mail, and the collectible is linked to your account or e-mail address.
5.2 Payment providers. Payments are processed by Stripe (cards, wallets, Twint), PayPal and TransFi (cryptocurrencies) under their own terms; they may carry out their own identity and fraud checks. The payment providers transfer the amounts received to UBUNɅTION, which receives them on behalf of the Charity Partner. We never see your full card details. Cryptocurrency payments are converted by TransFi; the amount in fiat currency we receive counts as the donation. Amounts are shown in the campaign currency; no fees are added at checkout. Your bank may charge conversion fees.
5.3 Withdrawal. You may withdraw a donation within 14 days of its completion without giving reasons, by an unequivocal statement to us (an e-mail to info@ubunation.com is sufficient; the model form in the Annex may be used). We refund the full amount within 14 days using the same means of payment. The collectible is withdrawn, and participation in a reward round based on that donation lapses. If you donated twice or the wrong amount by mistake, contact us; we correct this even after the 14 days have passed.
5.4 Chargebacks. Please contact us before initiating a chargeback with your bank or payment provider. If you initiate a chargeback for a correctly completed donation, we may withdraw the collectible, end your participation in reward rounds, suspend your account and, where permitted by law, charge you the chargeback fees we incur.
5.5 Refusal. We may decline or reverse a donation in case of suspected fraud, money laundering or abuse, for legal reasons or because of payment provider requirements; any amounts already received are refunded. We may limit the number of collectibles per person and campaign; any limit is shown on the campaign page.
6. Rewards from the Voices
6.1 Rewards. Voices and partners make rewards available to the supporters of a campaign, for example signed jerseys, event tickets, personal meetings, video messages, merchandise or experiences. Rewards are a thank-you from the Voices. They are not sold, no payment is required for them, and there is no entitlement to any particular reward. The rewards of a campaign, the period and the cut-off date of the allocation are shown on the campaign page.
6.2 Allocation. On the cut-off date, a reward is allocated at random among all participants of the relevant reward round; the procedure is documented. Participants are all persons who supported the campaign during the stated period, and all who registered without a donation under Section 6.3. Each person takes part in a reward round once, regardless of the amount donated and the number of collectibles held, and can receive at most one reward per reward round. Multiple accounts or e-mail addresses of the same person, as well as sham or self-support, lead to exclusion.
6.3 Participation without a donation. You can take part in a reward round without making a donation. To do so, send an e-mail to info@ubunation.com before the cut-off date with your name, your e-mail address and the name of the campaign (or use the form on the campaign page once available). Participation without a donation takes place on the same conditions and with the same chance as participation with a donation. A registration applies to the named campaign and the current period.
6.4 Requirements. Persons aged 18 or over with a valid e-mail address can take part. Excluded are employees and board members of UBUNTU NATION AG, employees and officers of the Charity Partner of the relevant campaign, the Voices providing the reward, and members of their households.
6.5 Notification and handover. The selected person is notified by e-mail to the address on record within 14 days of the cut-off date. They confirm acceptance within 14 days and give us the details needed for the handover; otherwise the reward is allocated anew. Rewards are handed over by UBUNɅTION or directly by the Voice. Experiences depend on the availability of the Voice; dates are proposed in good faith, and we may replace a reward with an equivalent one if it becomes unavailable. Rewards cannot be exchanged for cash. Unless the campaign page states otherwise, the selected person bears travel, accommodation, customs and import costs and any taxes. With their consent we may publish their first name or username.
6.6 Fixed rewards. Some contribution levels come with a fixed reward, for example the naming of a classroom or a signed item. These are not part of an allocation; they are described on the campaign page and handed over as described there.
6.7 Reservation. Reward rounds do not take place where they are not permitted by law; you may not take part if the law of your place of residence does not allow it. We may change, suspend or end a reward round for legal or technical reasons and will inform on the campaign page. Donations remain unaffected.
7. Accounts, profiles and content
7.1 You can donate without an account; you then appear on the Platform as "Anonymous". With an account (valid e-mail address, login by one-time code or password, one account per person, keep your login details safe and report any misuse) you can create a public profile. Username, avatar, bio, links, supported campaigns and collectibles are visible to everyone and controlled by you; you can change or remove them at any time and ask us to hide your profile. You keep the rights to your content and grant us a non-exclusive, worldwide, royalty-free licence to show it on the Platform and in our channels until you delete it.
7.2 You must be at least 18 years old to create an account or to donate; younger persons may do so only with the consent of a parent or guardian. You must not give false information, impersonate others, create multiple accounts, upload unlawful, infringing, hateful, pornographic or otherwise offensive content, harass others, use bots or scrapers, interfere with the Platform, or use it for fraud, money laundering or any other illegal purpose. In case of breaches we may remove content, suspend or close accounts and end participation in reward rounds.
7.3 You can close your account at any time by e-mail to info@ubunation.com; we delete it within 30 days, except data we must keep by law (see our Privacy Policy). If you believe content on the Platform infringes your rights, write to us; we will review it promptly.
8. Voices and Charity Partners
8.1 Voices are public figures who publicly support a campaign, usually free of charge, and provide rewards. By accepting a Voice profile or confirming your support, you grant UBUNɅTION and the Charity Partner the non-exclusive, worldwide, royalty-free right to use your name, image, statements and the content you provide for the campaign and its promotion on the Platform, in the newsletter, on social media and in press material, during the campaign and afterwards to document it. You undertake to post about the campaign at least once on your own channels with a link to the Platform, to provide the rewards you committed to, to comply with any advertising labelling obligations, and to refrain from conduct that could seriously harm the campaign or the Charity Partner. You can withdraw from future campaigns at any time by e-mail.
8.2 Charity Partners work with us on the basis of a written campaign agreement, are responsible for the accuracy of the information about their organisation and projects, and undertake to use the funds for the stated purpose and to report on it. A written agreement with a Voice or Charity Partner prevails over this Section.
9. Third-party services, availability and changes
Payment providers, social networks, blockchain networks and other third-party services are subject to their own terms; we are not responsible for them. We make reasonable efforts to keep the Platform available but do not guarantee uninterrupted or error-free operation, and we may change, add or discontinue features. If we discontinue the Platform, we announce this at least 60 days in advance, offer you a download of your collectibles and pay out any open Charity Partner shares. We may amend these Terms for good reasons (changes in law, new features, change of providers, security); registered users are informed by e-mail at least 30 days before material changes take effect, and continued use afterwards constitutes acceptance. Earlier donations remain subject to the Terms in force at the time.
10. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory product liability law. In cases of slight negligence we are liable only for the breach of essential contractual obligations and only for foreseeable damage typical for this type of contract. Any further liability of UBUNɅTION and of our board members, employees and agents is excluded to the extent permitted by law. In particular, we are not liable for third-party services, for events beyond our control, for the conduct of Charity Partners and Voices, or for the condition and handover of rewards provided by third parties; we will assist you in good faith. Statutory consumer rights remain unaffected. You are responsible for your own content and your use of the Platform and, to the extent you are responsible for a breach, for third-party claims resulting from it.
11. Applicable law and final provisions
Swiss law applies, excluding its conflict-of-law rules. Consumers habitually resident in the EU, the EEA, the United Kingdom or Switzerland additionally benefit from the mandatory provisions of the law of their state and may bring proceedings before the courts of their place of residence; otherwise the courts of Zug, Switzerland, have jurisdiction. We are neither obliged nor willing to take part in proceedings before a consumer arbitration board; please contact us first at info@ubunation.com. If a provision of these Terms is invalid, the remaining provisions remain in force. These Terms are published in German and English; in case of discrepancies the English version prevails unless mandatory law requires otherwise.
